GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

Artisanal Fine Jewelry — Authentically Handmade in France In force as of May 2026

These General Terms and Conditions of Sale (GTCS) exclusively govern the contractual relationship between the independent artisan jeweler (hereinafter referred to as "the Seller") and any individual making a purchase on the online store (hereinafter referred to as "the Client").

Article 1 — Product Characteristics & Artisanal Philosophy

Each jewelry piece offered on the online store is an original creation designed, developed, and entirely handcrafted by the artisan in their workshop located in France. This traditional manufacturing method involves essential contractual specificities accepted by the Client:

  • Product Images & Displays: Product photographs displayed on the online store are intended to be as accurate as possible. However, due to the fully handmade process and display settings, the final piece may vary slightly from the picture in terms of general appearance, fine details, and dimensions/sizing. The visuals are provided for illustrative purposes and carry no non-negotiable contractual warranty regarding strict conformity to the image.

  • Absence of industrial molds: Because no industrial mass-molding processes are used, every single piece is unique and cannot be exactly replicated. The artisan retains the right to create new pieces inspired by previous designs, but due to the organic nature of the process, a new creation will never be 100% identical to a past one. Consequently, slight variations in dimensions (size, thickness), textures, and color shades may occur from one piece to another. These variations are not defects; instead, they serve as proof of the authenticity of fine handcraft.

  • Recycled Silver: As part of an eco-responsible approach, the majority of the precious metals used is sourced from recycled silver.

  • Maker's Hallmark (Poinçon de Maître): In compliance with French legislation and the guarantee of precious metals, all pieces feature the artisan's personal maker's hallmark, certifying their identity as the creator and the purity of the metal used.

Article 2 — Specific Clause Regarding Stones

The Seller is deeply committed to an ethical approach and practices a responsible, alternative sourcing method for the gemstones and stones used in the jewelry. Due to this non-standardized procurement method focused on the curation of unique lots: The Seller cannot contractually guarantee the absolute purity level, certified laboratory origin, or the exact and exhaustive geological nature of the stones. Consequently, the Seller shall not be held liable for the structural purity, natural evolution of inclusions, or the precise nature of the stones included in the jewelry piece. 

Article 3 — Pricing and Payment

Prices displayed on the online store are indicated in Euros (€), inclusive of all taxes (TTC) according to the fiscal tax regime applicable to the artisan (Note: e.g., VAT not applicable under Article 293 B of the French General Tax Code for micro-entrepreneurs, or subject to VAT according to current rates), and exclude shipping costs. Payment is due in full at the time of order validation via the secure payment methods provided on the platform.

Article 4 — Special and Custom Orders

Personalized orders or custom creations are strictly regulated due to their exclusive nature:

  • Production Delays: Production times for custom orders are provided as an estimate only and may vary unpredictably based on technical complexity, sourcing, or the artisan's current workload. Any extension or variation of this timeframe shall under no circumstances justify the unilateral cancellation of the sale by the Client, nor shall it entitle the Client to any damages or compensation.

  • Visual Updates Before Shipping: Before dispatch, the Seller will make every effort to send photographs or videos of the completed custom piece to the Client upon request, for informative purposes. However, the sending of these visuals is not a mandatory requirement for order fulfillment, and shipping is not legally contingent upon the Client's explicit prior approval.

  • Cancellation Policy: In accordance with Article L221-28 of the French Consumer Code, orders for personalized items or goods made to the consumer's specific specifications cannot be canceled, modified during production, or refunded, unless prior, written, and express approval is granted by the Seller.

  • Client Responsibility for Sizing: The Client is solely responsible for providing accurate measurements and sizes (e.g., ring sizes or wrist measurements) when placing a custom or personalized order. The Seller manufactures the piece precisely according to the specifications provided by the Client and cannot be held liable, nor will a refund or modification be automatically granted free of charge, if the piece does not fit due to incorrect sizing information supplied by the Client. Any subsequent resizing or adjustments requested by the Client will be subject to a separate fee and additional shipping costs.

Article 5 — Right of Withdrawal (Droit de Rétractation) and Exchange Policy

For standard catalogue items only (excluding custom and personalized orders):

In compliance with French law, the Client has a legal period of 14 calendar days from the date of receiving their jewelry piece to exercise their right of withdrawal and request a refund from the Seller. The product must imperatively be returned brand new, unworn, in its intact original packaging, and with its original hallmark. Return shipping costs are borne exclusively by the Client.

Return Shipping Requirements: In the event of a return, the Client must send the jewelry piece back in its original packaging or a strictly similar alternative. The piece must be enclosed in a secure, highly protective package and sent via a shipping method that includes tracking. The Client is responsible for packaging the item with utmost care to ensure it does not break or suffer any damage during transit. The Seller reserves the right to refuse a refund if the item arrives damaged due to inadequate or careless packaging by the Client.

Strict Rule Regarding Exchanges: Due to the unique management of a small independent artisan inventory, the Seller informs the Client that no exchanges are accepted. If the Client requires a different model or size, they must exercise their right of withdrawal for a refund and place a brand new order on the online store.

Article 6 — Exclusion of Liability: Misuse and Degradation

Handcrafted jewelry consists of delicate, precious objects that require careful handling. The artisan’s liability is strictly limited to original manufacturing defects and non-conformities. The Seller shall not be held liable for any degradation, breakage, premature oxidation, deformation, or loss of elements resulting from misuse, negligence, or lack of appropriate care by the Client (including but not limited to: exposure to seawater, chlorine, cosmetics, or perfumes; thermal or physical shocks; mechanical pressure exerted on the jewelry structure; or inadequate storage).

Article 7 — Gemstone Repair Service (3-Month Guarantee)

Despite the extreme care dedicated to manual gemstone setting, accidents can happen. If a stone should become loose or fall out, the Client is invited to contact the artisan immediately via email.

A free repair and stone replacement coverage is guaranteed for a maximum duration of 3 months from the date of delivery, provided that the stone fall results from a hidden manufacturing defect and not from physical impact, mechanical stress, or inappropriate usage by the Client.

After this 3-month period, or if visual evaluation of the piece indicates that the damage stems from impact, pressure, neglect, or improper care, repairs and gemstone replacements will be subject to a separate fee quotation. Return shipping costs to the workshop remain the exclusive responsibility of the Client in all circumstances.

Article 8 — Privacy and Data Protection (GDPR)

In accordance with the General Data Protection Regulation (GDPR) and the French "Informatique et Libertés" law, personal data collected from the Client (last name, first name, delivery address, email address, phone number) is mandatory for processing, invoicing, and shipping orders. This data remains strictly confidential, is never shared or sold to third parties, and is retained solely for the legal and fiscal requirements of the business. The Client retains the right to access, rectify, port, and delete their data by contacting the artisan directly.

Article 9 — Applicable Law and Disputes

These terms are governed exclusively by French law. In the event of a dispute or claim, the Client agrees to first contact the artisan directly to seek an amicable solution. If no amicable agreement is reached, the consumer Client is informed of their right to use a consumer mediator free of charge, in accordance with the provisions of the French Consumer Code.
